RELEASE OF LIABILITY FOR PARTICIPANTS/SWIMMERS

IN CONSIDERATION OF my child(ren)/ward(s) being allowed to participate in any way in West Houston Aquatic League, Inc. (“WHALe”) events and activities, the undersigned hereby represents, acknowledges, appreciates, understands, consents, and agrees that:

1. All of the information that I or my spouse have provided to WHALe or its member teams is true and correct to the best of my knowledge and, in the event that I, my spouse, or any of my child(ren)/ward(s) obtains knowledge that any such information is untrue or incorrect, I will immediately provide true and correct information to the executive board or similar governing entity for my member team; and,

2. The risk of injury to my child(ren)/ward(s) from participation in WHALe events and activities is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk for serious injury does exist; and,

3. I for myself, my spouse, and my child(ren)/ward(s), knowingly and freely ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of WHALe or its member teams or its and their directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, the owners and/or lessors of the premises used to conduct the event (collectively, the “Releasees”), and ASSUME FULL RESPONSIBILITY for the participation of my child(ren)/ward(s) in WHALe events and activities; and,

4. I willingly agree to comply with the WHALe’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child(ren)/ward(s) readiness for participation and/or in any WHALe event or activity itself, I will remove my child(ren)/ward(s) from the participation and bring such attention of the nearest official immediately; and,

5. I for myself, my spouse, my child(ren)/ward(s), and on behalf of my/our heirs, assignees, personal representatives and next of kin, hereby RELEASE AND HOLD HARMLESS the Releasees, WITH RESPECT TO ANY AND ALL ILLNESS, INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY incident to my child(ren)/ward(s) involvement or participation in WHALe events and activities, EVEN IF ARISING FROM THE NEGLIGENCE of the Releasees or otherwise, to the fullest extent permitted by law; and

6. I, for myself, my spouse, my child(ren)/ward(s), and on behalf of my/our heirs, assignees, personal representatives and next of kin, hereby INDEMNIFY the Releasees from any and all liabilities incident to my child(ren)/ward(s) involvement or participation in WHALe events and activities, EVEN IF ARISING FROM THE NEGLIGENCE of the Releasees or otherwise, to the fullest extent permitted by law; and,

7. In the event that any knowingly incorrect information provided by me or my spouse to WHALe or any of its member teams results in any additional liability, exposure, loss, or damage for any or all of the Releasees, I, for myself, my spouse, my child(ren)/ward(s), and on behalf of my/our heirs, assignees, personal representatives and next of kin, HEREBY ASSUME RESPONSIBILITY FOR, AND INDEMNIFY AND HOLD HARMLESS the Releasees for, all such liability, exposure, losses and damages.

I HAVE READ THIS RELEASE OF LIABILITY, FULLY UNDERSTAND ALL TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING, AND SIGN THIS RELEASE OF LIABILITY FOR PARTICIPANTS/SWIMMERS FREELY AND VOLUNTARILY WITHOUT INDUCEMENT.

2026 PINE MILL RANCH SWIM TEAM RELEASE OF LIABILITY FOR SWIMMERS/PARTICIPANTS/SPECTATORS

IN CONSIDERATION OF my child/children being able to participate in any way (swimming, concessions, event running, or otherwise) with the Pine Mill Ranch Swim Team (“PMRST”) or West Houston Aquatic League, Inc. (“WHALe”), the undersigned on behalf of himself/herself and on behalf of my child/children hereby represents, acknowledges, appreciates, understands, consents, and agrees that:

1. I have read, acknowledge and agree to abide by the posted/published rules and regulations covering the Pine Mill Ranch Homeowners Association, Inc. (“Association”) facilities (defined as including but not limited to: the swimming pools, pool grounds, sidewalks, parking lots, playgrounds, pool deck, restrooms, and concession areas.)
2. I agree to assume the risks involved with the use of the Association facilities.
3. The potential risk of injury to me and my child/children from participation in PMRST events and activities is significant, including the risk for potential permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk still exists.
4. I for myself and my child/children knowingly and freely ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF PMRST, WHALe, OR THE ASSOCIATION, or opposing teams and their directors, officers, officials, agents, employees, volunteers, other participants, sponsors, advertisers, on the on or at the facilities and ASSUME FULL RESPONSIBILITY for the safety and welfare of myself and my child/children.
5. I for myself and my child/children and on behalf of their heirs, assignees, personal representatives and next of kin, hereby RELEASE, INDEMNIFY, AND HOLD HARMLESS, PMRST, WHALe, and the ASSOCIATION, and their respective heirs, legal representatives, members, managers, volunteers, partners, agents, employees, officers, directors, shareholders, parents and subsidiaries FROM AND AGAINST ALL CLAIMS, demands, damages, injuries, losses, liens, cause of action, suits, judgements, liabilities and expenses, including court costs and attorney’s fees of any nature, kind or description (including without limitation, claims for property damage, injuries to or death of any person or entity) arising out of the use of the facilities owned by or under control of the Association, or arising out of activities supported by PMRST.
6. THE OBLIGATIONS OF MEMBER/GUEST UNDER THIS INDEMNIFICATION SHALL APPLY EVEN IF SUCH LIABILITIES ARE CAUSED IN WHOLE OR PART BY THE SOLE OR CONCURRENT NEGLIGENCE OF PMRST, WHALe, and/or the ASSOCIATION AND WHETHER OR NOT SUCH SOLE OR CONCURRENT NEGLIGENCE OF PMRST, WHALe and THE ASSOCIATION WAS ACTIVE OR PASSIVE OR BY MATTER OR THING IN WHICH LIABILITY MIGHT BE IMPOSED.
7. I agree that in the event any law is enacted, (which governs this agreement and which limits in any way the extent to which indemnification may be provided to the Association), this agreement shall automatically be amended to provide that the indemnification provided here-under shall extend only to the maximum extent permitted by applicable law.
8. This Agreement shall further constitute a waiver of subrogation by me against PMRST, WHALe, and the Association and its insurance carriers.
9. FURTHER, I ACKNOWLEDGE THAT I SHOULD CHECK WITH A LICENSED MEDICAL PROFESSIONAL TO ASCERTAIN WHETHER I OR MY CHILD/CHILDREN ARE PHYSICALLY ABLE TO PARTICIPATE IN SUCH ACTIVITIES AND WHETHER IT IS SAFE TO DO SO. I UNDERSTAND THAT MY ACTIVITIES INCLUDE THE ABOVE RISKS AND I HEREBY EXPRESSLY ASSUME THE RISK OF INJURY, ILLNESS, DEATH, PROPERTY DAMAGE OR ANY OTHER HARM OF ANY NATURE WHATSOEVER FROM THESE ACTIVITIES.

I HAVE READ THIS RELEASE OF LIABILITY, FULLY UNDERSTAND ALL TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING, AND SIGN THIS RELEASE OF LIABILITY FOR PARTICIPANTS/SWIMMERS FREELY AND VOLUNTARILY WITHOUT INDUCEMENT.

Please read through and acknowledge the following information about the Pine Mill Ranch Swim Team:

MANDATORY NEW PARENT MEETING: At least one parent or guardian must attend on APRIL 26, at 2:00pm at PMR poolside. 

SEASON DATES: May 1 to June 30th.  Last regular season practice is June 19.

PRACTICE: Practice is after school when school is in session and before 10am when school is out of session. Please go to www.pmrrays.com and view the Practices Tab to find your child’s practice times.

VOLUNTEER COMMITMENT: Each family must volunteer 3 shifts for one child and 2 additional shifts for each additional child. If you are unable to complete your volunteer obligation, your family will be suspended from the team for a year and must wait until open registration to join the following year in which there will be no guarantees for a place on the team.

SWIM MEET COMMITMENT: Each child must swim a minimum of 2 dual swim meets (practice meet is not a dual swim meet). Any child who swims less than two dual meets will be suspended from the team for a year and must wait until open registration to join the following year in which there will be no guarantees for a place on the team.

REFUND POLICY: 90% refund for registration cancellations prior to the first day of practice. 50% refund during the first week of practice. No refunds will be given after the first week of swim team practice. Any unforeseen circumstances (loss of job, relocation or swimmer injury) will be reviewed by the PMRST Board.

TEAM SWIMSUIT: Each swimmer needs to purchase the PMRST swim suit and wear the suits at every swim meet. Swim suits can ONLY be purchased at D&J Sports location at 617 S Mason Road.  

POLICIES: Parents must read the Parent Code of Conduct. Parents will review the Swimmer Code of Conduct with their children. These policies are located at www.pmrrays.com under the Policies Tab as well as the Team Handbook.

I, parent/guardian, hereby grant permission to Pine Mill Ranch Swim Team representatives, to take and use: photographs and/or digital images of the child(ren) named above for use in news releases and/or promotional materials. These materials might include printed or electronic publications, web sites, or other electronic communications. I further agree that name and identity may be revealed in descriptive text or commentary in connection with the image(s). I authorize the use of these images without compensation. All prints and digital reproductions shall be the property of Pine Mill Ranch Swim Team representatives.
